Conditions For Digital Reproduction

General Information

All requests for permission to reproduce or have access to electronic images from the Carnegie Museum of Art will be evaluated on a case-by-case basis.

Permission to reproduce is conditional on the unequivocal acceptance of these regulations.  Any breach of these terms and conditions will automatically result, at the sole discretion of the Museum, in the revocation of permission to reproduce.  Payment of appropriate compensation or damages to the Museum by the applicant may also be considered.

Permission to reproduce and the fee payable cover only the specific use detailed in the application.  Any additional use of any kind must be preceded by a new application and is not covered by the original fee or permission to reproduce.

The Museum assumes no responsibility for claims against the applicant or the Museum by third parties.  The applicant agrees to indemnify the Museum and hold it harmless against any and all such claims and costs, including copyright infringement claims arising out of the applicant’s reproduction of the work(s) in question.

The Museum makes no warranties or representation and assumes no responsibility whatsoever for any claims, royalties, or fees demanded by an artist, his agent, estate, or by any other party in connection with the reproduction of artworks in the Museum’s collections.  Additionally, the applicant agrees to indemnify the Museum and hold it harmless against any and all such claims, demands, and/or actions, including the costs thereof, arising as a result of the applicant’s reproduction of the Museum’s artworks.

Applicants must delete electronic images from their files upon completion of the publication/website posting/CD ROM of the reproduction for which permission has been obtained.

Electronic Reproduction of the Museum’s Photographic Materials for Reproduction and Educational Purposes

The applicant must obtain special permission from the Coordinator of Rights and Reproductions in order to scan/electronically reproduce any color transparencies, slides, and/or prints for reproduction purposes. The Museum may specify usage guidelines associated with resolution, access to, and usage of the resultant scanned image by the applicant and the public.

Any applicant that requests permission to scan/electronically reproduce color transparencies, slides, and/or prints for educational/research purposes, will be required to sign an agreement that strictly prohibits any commercial use of the scanned image.

The Museum does not supply photographic materials of works in its collection to companies or individuals operating a photograph rental and/or sales service.  Applicants will be required to represent, as a precondition for permission to reproduce, that no such use will be made of any material obtained from the Museum.

Use of Electronic Images Obtained from the Museum for Media and Other Reproduction Purposes

The applicant must obtain electronic images for reproduction directly from the Carnegie Museum of Art. Reproduction of electronic images of artworks in the Museum’s collections  obtained from any other source is strictly prohibited.

Any applicant requesting permission to reproduce electronic images for media/publicity purposes must obtain the proper reproduction permission from the Communications Manager.

Any applicant requesting permission to reproduce electronic images for purposes other than media or publicity must obtain the proper reproduction permission from the Coordinator of Rights and Reproductions.

Any applicant requesting permission to reproduce electronic images for educational/research purposes will be required to sign an agreement that strictly prohibits any commercial use of the scanned image.

Copyright Identification Information for Media and Other Reproduction Purposes

When an electronic image obtained from the Museum is reproduced in print, copyright identification information must accompany the reproduction, either next to the reproduction or in an acknowledgments section of the publication.

The applicant must list the above copyright identification information as specified by the Museum.  Any changes to or fraudulent representation of the copyright information specified by the Museum is strictly prohibited.

Image Quality for Media and Other Reproduction Purposes

The paint area of a composition, or the area within the outline of a sculpture, may not be masked out, superimposed with type matter, or in any way altered or defaced.  Reproductions that bleed are therefore only permitted in the case of “details”.

Requests to reproduce a detail from an artwork will be considered only upon receipt of a sketch or marked-up photograph showing the area to be reproduced.  The caption must contain the word “detail”.

Requests to reproduce a cropped version of an artwork also require the submission of a sketch or marked-up photograph.

The Museum reserves the right, in its sole discretion, to refuse permission for further applications from a publisher or other applicant, if in its opinion, the standard of the reproduction has not been of acceptable quality.

Website/Internet/CD ROM Reproduction

The Museum reserves the right, in its sole discretion, to place restrictions on the specific uses of an electronic image. (i.e., the public’s access to the image, the image resolution, whether or not the image may be downloaded, etc.)

The Museum reserves the right, in its sole discretion, to require an applicant to remove or bring up to acceptable standards any reproduction that is deemed inappropriate or that is
of substandard quality.

Guidelines for the Use of Electronic Images Furnished to the Museum for Temporary Exhibitions

Any applicant requesting permission to reproduce electronic images for media/publicity purposes must obtain the proper reproduction permission from the Communications Manager.

Any applicant requesting permission to reproduce electronic images for purposes other than media or publicity must obtain the proper reproduction permission from the Coordinator of Rights and Reproductions.

The Museum will only permit the reproduction of electronic images of artworks in temporary exhibitions (artworks that are not part of the Museum’s collections) as specified by the individuals and/or institutions that provide the Museum with these images.

In addition to all of the above-mentioned conditions, the Carnegie Museum of Art may require the applicant’s compliance with any additional rules, guidelines, and restrictions that the individuals and/or institutions that loan the images to the Museum, may specify.

Unless otherwise specified, electronic images of artworks in temporary exhibitions that are not part of the Museum’s collections will not be made available for use by the public, from the Museum, after the closing of the exhibition.
